Article 1. Definitions

18) seller - an entity that pursuant to the agreement sells consumer goods and offers them for implementation;

22) Consumer - an individual who purchases, orders, uses or intends to purchase or request products for personal purposes not directly related to business activities or duties of an employee;

Article 4. Rights and obligations of consumers

1. Consumers in the purchase order or use of products sold in Ukraine, to meet their personal needs are entitled to: 1) protection of their rights by the state; 2) proper quality products and services; 3) product safety; 4) necessary, accessible, accurate and timely information on products and their quantity, quality, range, and its manufacturer (performer, seller); 5) damages (losses) caused by defective or counterfeit products or products of poor quality, or property, and moral (non-property) damage dangerous to life and health products in the cases provided by law; 6) apply to the courts and other authorized state bodies for protection of violated rights; 7) unite in public organizations of consumers (consumer association).

2. Consumers also have other rights established by law on consumer protection.

3. Consumers must: 1) prior to the operation of the goods carefully review the rules of operation set forth in the manufacturer's (seller, executor) documentation for the goods; 2) if necessary, explaining the conditions and terms of use of the product - before using the product to ask for clarification to the seller (manufacturer, performer) or other specified person in the service documentation, performing their functions; 3) use the product according to his purpose and adhere to the conditions (requirements, rules, regulations), the manufacturer of the goods (contractor) in service documentation; 4) to prevent negative consequences for the consumer use the product - used by manufacturers in the product safety in compliance with the operational documentation provided by special regulations, and in the absence of such rules in the documentation - The usual reasonable security measures established for such goods.

Article 5. Consumer Protection

1. The State ensures the protection of consumers of their rights, allows free choice of products, the acquisition of knowledge and skills needed to make independent decisions when purchasing and using products according to their needs, and guarantees of purchase or receipt of goods by other lawful means to the extent that provides a level of consumption adequate for the health and life. 2. The State creates conditions for obtaining the required knowledge by consumers for exercising their rights. 3. Consumer protection Specially authorized central executive body in the field of consumer protection and its territorial bodies, the Council of Ministers of the Autonomous Republic of Crimea, local state administration bodies and bodies exercising state sanitary and epidemiological surveillance, and other executive agencies, local governments accordance with the law and courts.

Article 6. Consumer's right to adequate quality

1. The seller (manufacturer, performer) shall pass to the consumer products of good quality, and provide information about these products. 2. The seller (manufacturer, performer) at the request of the consumer is obliged to give him documents proving the proper quality. 3. Requirements for the production of its safety for human life, health and property of consumers and the environment established by regulations. For certain groups of products specified requirements set by laws and other regulations. 6. The interests of consumers in setting requirements for good quality products are ensured the right of participation of consumers and their associations in the development of regulations under the law.

Article 7. Warranty

1. Producer (executor) ensures proper operation (application use) products, including components, within the warranty period set by regulations, regulations or contract. Article 8. Consumer rights in case of acquisition of the goods of improper quality 1. If it finds within the established warranty period shortcomings consumer, in the manner and within the terms established by law, may request: 1) proportional reduction in prices; 2) free product deficiencies within a reasonable time; 3) reimbursement for corrective product.

If you find within the established warranty period of significant deficiencies that have arisen through the fault of the product manufacturer (seller, executor), or falsification of the product confirmed the need for an expert opinion, the consumer, in the manner and within the terms established by law and based on required 'binding on the parties to the rules or contract, is entitled to their choice to require the seller or manufacturer: 1) termination of the contract and return the paid sum of money for goods; 2) require the replacement product for the same product or the like, with the number available to the seller (manufacturer) product. 2. For non-food items that were in use and were sold through retail commission trade enterprise customer requirements, specified in part one of this article are satisfied with the consent of the seller. According to this part are met customer requirements for products, the warranty period are not expired. 3. Consumer requirements established in part one of this article shall be filed on consumer choice seller at the place of purchase product, manufacturer or company that satisfies these requirements at the location of the consumer. Upon termination of the contract settlement with the consumer if the price of the goods shall be made based on its value at the time of submission of a request, and if a price reduction - based on the value of the goods at the time of purchase. Money paid for goods returned to the consumer on the day of termination, and in case of failure to return the money the day of termination of the contract - in other period agreed by the parties, but not later than seven days. 9. When presenting the consumer demands for unpaid deficiencies goods they must be removed within fourteen days from the date of presentation or by agreement to another term. Customer requirements are considered after the presentation of customer settlement document, and on goods, which set the warranty period - technical certificate or other document in lieu thereof, marked with the date of sale. When selling a product seller must give the consumer settlement document prescribed form, confirming the purchase, marked the date of sale. In case of loss of customer technical certificate or other document that replaces it, their recovery is carried out in accordance with the law. 14. The requirements of the consumer under this Article shall not be satisfied if the seller, the producer (enterprise that meets customer requirements established in part one of this article) prove that the product defects resulting from violation of the rules of consumer goods use or storage. The consumer has the right to participate in checking the quality of the product personally or through his representative.

Article 9. Consumer rights when buying goods of good quality

1. The consumer has the right to exchange non-food products of good quality for the same from the seller, in which it was purchased, if the goods are not satisfied with its shape, size, style, color, size or other reasons it can not be used for other purposes. The consumer has the right to exchange the goods of good quality within fourteen days, not counting the day of purchase. Exchange of goods is made of good quality if it is not used and if saved his marketability, consumer properties, seals, labels, and the current document issued by the consumer with the goods sold. The list of goods not subject to the exchange (return) on the grounds mentioned in this article, approved by the Cabinet of Ministers of Ukraine. 2. If at the time of exchange of the like product is not selling, the consumer has the right to purchase or any other goods from the existing range with the appropriate transfer price, or cancel the contract and receive a refund in the amount of returned goods, or exchange the product for the same at the first receipt of the product on sale. The seller must on the day of receipt of goods for sale to inform the consumer that requires the exchange of goods. 3. Upon termination of the contract of sale transactions with customers are conducted based on the value of the goods at the time of his purchase. Money paid for goods returned to the consumer on the day of termination, and in case of failure to return the money the day of termination of the contract - in other period agreed by the parties, but not later than seven days.

Section V

MISCELLANEOUS

1. This Act shall take effect after its publication. The provisions of the first sentence of paragraph 3 of Article 26 in part payment for samples and conducted research (examination) from the state budget takes effect on January 1, 2007. By that date the said payment is made by entities that are checked. 2. To comply with this Law and other regulations apply to the extent not inconsistent with this Act. 3. Cabinet of Ministers of Ukraine within six months from the date of enactment of this Act: 1) prepare and submit to the Verkhovna Rada of Ukraine proposals to bring other laws into conformity with this Law; 2) according to their competence to ensure the adoption of regulations under this Act, and 3) bring their regulations into compliance with this Act; 4) provide the review and cancellation by ministries and other central executive bodies of the legal acts that contradict this Law ".
